EU AI Act Applies from August 1st, with Phased Enforcement through 2027

On July 12, 2024, the European Union’s Artificial Intelligence Act, Regulation (EU) 2024/1689 (“EU AI Act”), was published in the EU Official Journal. The EU AI Act formally applies across all 27 EU Member States on August 1, 2024. Yet its enforcement will be phased, with the majority of its provisions becoming fully binding on August 2, 2026.

The timeline for the EU AI Act is as follows –

  • February 2, 2025 – Enforcement of Chapter I, which includes definitions and general provisions, and Chapter II, concerning prohibited uses of artificial intelligence, will begin.
  • May 2, 2025 – Codes of practice will be ready.
  • August 2, 2025 – Parts of Chapter III (specifically Part IV, regarding reporting obligations to regulatory bodies), Chapter V (provisions for the development and use of general-purpose AI models), Chapter VII (policies at the union and national-state levels), Chapter XII (sanctions, except for Article 101 concerning fines on providers of general-purpose AI), and Article 78 (which establishes confidentiality obligations for regulatory bodies) will become effective.
  • August 2, 2026 – All rules of the AI Act will become applicable, including obligations for high-risk systems defined in Annex III (list of high-risk use cases). Member States must ensure that their competent authorities have established at least one operational AI regulatory sandbox at the national level.
  • August 2027 – Obligations imposed on high-risk AI systems defined in Annex I will become binding.
